Welcome to Alisha Nicholson's Art. These Terms of Service (“Terms”) govern your use of our website and your purchase of artwork, prints, commissions, and digital products from us. The shop is operated by Nicholson Ventures Ltd (111 Rue Main Street, Fredericton, New Brunswick, E3A 1C6, Canada). By using the site or placing an order, you agree to these Terms.

Our artwork & products

We offer original paintings, fine-art paper and canvas prints, custom commissions, and digital products such as devotionals. Each piece is created with care. Because artwork is handmade or made to order, and because screens display color differently, the exact colors, texture, and finish of what you receive may vary slightly from the images shown. Originals are one of a kind; once sold, they are no longer available.

Pricing, currency & taxes

Prices are shown in Canadian dollars (CAD) for customers in Canada and in U.S. dollars (USD) for customers elsewhere, based on your region. Prices are subject to change, and we may correct any pricing errors. Any applicable taxes or duties are your responsibility unless stated otherwise.

Payment & orders

Payments are securely processed by Stripe. By placing an order you confirm you are authorized to use the payment method provided. Your order is an offer to buy; we may accept, decline, or cancel any order (for example, if an item is unavailable, a price was listed in error, or we suspect fraud). If we cancel a paid order, we’ll refund it.

Shipping & delivery

U.S. print orders are produced and shipped domestically within the United States by our print partner (Gelato). Orders to Canada and the rest of the world are carefully packaged and shipped from the studio. Delivery times are estimates and not guaranteed. For international orders, any customs fees, import duties, or taxes are the customer’s responsibility. See our Shipping policy for details.

Returns, refunds & damaged items

Please review our Returns policy. Original paintings, commissions, and digital products are generally non-refundable except as required by law. If your order arrives damaged or is lost in transit, contact us promptly at Alishanicholsonsart@gmail.comwith your order details and photos, and we’ll make it right.

Commissions

Commissioned work is custom-made for you. We’ll agree on scope, size, price, and timeline before beginning. Commissions may require a deposit, which is non-refundable once work has started, since materials and time are reserved for your piece. Timelines are estimates. We reserve the right to decline any commission request. Final artwork may vary naturally from any preliminary sketches or references.

Digital products

Digital products (such as the devotional) are delivered electronically by download link or email. Because they are delivered instantly and cannot be returned, all digital purchases are final and non-refundable. You are granted a personal, non-commercial license to use your download for your own use. You may not resell, redistribute, or share the file publicly.

Intellectual property

All artwork, images, designs, and text on this site are the property of the artist and Nicholson Ventures Ltd, and are protected by copyright. Purchasing a print, original, or digital product gives you ownership of that item for personal enjoyment only — it does not transfer copyright or any reproduction rights. You may not copy, reproduce, resell, or use the artwork for commercial purposes without our written permission.

Acceptable use

You agree to use the site lawfully and not to interfere with its operation, attempt to gain unauthorized access, or use it in any way that could harm us or other visitors.

Disclaimers & limitation of liability

The site and its content are provided “as is.” To the fullest extent permitted by law, Nicholson Ventures Ltd is not liable for any indirect or incidental damages arising from your use of the site or products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Nothing in these Terms limits rights you have under applicable consumer-protection law.

Governing law

These Terms are governed by the laws of the Province of New Brunswick, Canada, without regard to conflict-of-law rules. Any disputes will be handled by the courts located in that jurisdiction.

Changes to these Terms

We may update these Terms from time to time. The “last updated” date above reflects the current version, and your continued use of the site means you accept the updated Terms.
